The Family Justice Courts and Syariah Court

The Courts adopt a child-centric approach where the children’s welfare is always the Courts’ paramount consideration. 

Family Justice Courts 

To get a divorce, you would need to file for divorce with the Family Justice Courts and comply with the legal requirements for divorce. The Women’s Charter governs the law on divorce for civil marriages in Singapore.

Syariah Court 

Muslim marriages would need to apply for divorce under the Syariah Court.

The Syariah Court has jurisdiction over matters and proceedings in which: 

a. Both parties are Muslim; or 

b. The parties were married under the provisions of the Muslim law; and 

c. The disputes relate to:

  • Divorces
  • Division of property on divorce
  • Payment of emas kahwin, marriage expenses, divorce maintenance and consolatory gifts 

The Court offers counselling for Muslim couples with marital difficulties. It also offers mediation in divorce cases with the aim to discuss and settle ancillary matters amicably.
