ISIFPSC Identification Card (WC, CYPA, VAA) - Protector

  1. The card holder is appointed by the Minister under Section 65(2)(b) of the Women’s Charter to undertake the following:
    1. apply for a Protection Order/Expedited Order (PO/EO) on behalf of any person below the age of 21 years or an incapacitated person;

    2. accept service of documents related to any such application for a PO/EO; and

    3. act on behalf of any person below the age of 21 years or an incapacitated person in proceedings related to any application for a PO/EO.

  2. The card holder is authorised by the Director-General of Social Welfare (DG), with the approval of the Minister, under Section 3(3) of the Children and Young Persons Act (CYPA), in relation to a child and young person (CYP), to undertake the following: 
    1. perform the powers and exercise the duties of a Protector:
      1. to obtain and communicate information in relation to a CYP;
      2. to order a CYP to be produced for assessment or treatment, etc.; and

    2. perform the power and exercise the duty of the DG to enter into voluntary care agreements.

  3. The card holder is appointed by the DG under Section 3(3) of the Vulnerable Adults Act (VAA) as an AWO to exercise the following powers under the VAA:  
    1. apply to the court for orders under sections 14 (1) (e), (f), (g), (h) and 15 of the VAA in relation to a vulnerable adult (VA) if: 
      1. the VA consents to the application(s); or
      2. the VA is assessed by a mental capacity assessor to lack the mental capacity to consent to the application(s);

    2. supervise a VA, if the court makes an order placing the VA under the supervision of an AWO under section 14(1)(d) of the VAA.

    3. apply to the court for the variation, suspension or revocation of an order under section 14(1)(d) of the VAA (whether or not the AWO had earlier applied for that order) if:
      1. the VA consents to the application(s); or 
      2. the VA is assessed by a mental capacity assessor to lack the mental capacity to consent to the application(s);

    4. apply to the court for the variation, suspension or revocation of an order under sections 14 (1) (e), (f), (g), (h) and 15 of the VAA if an AWO had earlier applied under section 12 of the VAA for that order and if:
      1. the VA consents to the application(s); or 
      2. the VA is assessed by a mental capacity assessor to lack the mental capacity to consent to the application(s).
