Number of Lasting Powers of Attorney Cases Involving Fraud or Abuse in Past Three Years

Type: Parliamentary Questions

Topic(s): Children & Families

Mr Sitoh Yih Pin asked the Minister for Social and Family Development in the past three years, how many cases of Lasting Powers of Attorney (LPAs) involve fraud or abuse.

Answer

1. Since 2018 to date, there was one case where the powers of the donee under the Lasting Power of Attorney (LPA) were curtailed by the Court on grounds of financial abuse. We have more than 120,000 LPAs registered as of May 2021.

2. OPG encourages anyone who knows, suspects or believes that a person who lacks capacity is being neglected and/or needs care or protection, to report it to the OPG. The Mental Capacity Act protects the identity of the 'whistle-blower' when such reports are made.
