The Office of the Public Guardian

The Public Guardian

The Public Guardian carries out functions under section 31 of the Mental Capacity Act (MCA) to enable and protect persons who lack mental capacity. These functions include:

  • Setting up and maintaining a register of Lasting Power of Attorney ("LPA")
  • Setting up and maintaining a register of Deputies appointed by court
  • Supervising deputies
  • Receiving reports from Donees and Deputies
  • Investigating any alleged violation of any provision in the MCA, including complaints about the way in which Donees and Deputies are exercising their powers*

*OPG supervises or investigates matters which involve an LPA or deputyship. For all other matters, individuals are encouraged to report the case to the police.

The Public Guardian does not provide legal advice, such as interpreting the sections of the Mental Capacity Act, advising on the powers of the Donees, or intervening in family disputes. Members of public should seek mediation services or legal advice for such matters.

 

The Office of the Public Guardian

The Office of the Public Guardian (“OPG”) was established in 2010.

The OPG is a Division of the Ministry of Social and Family Development (MSF). The Office supports the Public Guardian in carrying out his/her functions.
